Montana Medical Marijuana Ruled by State Supreme Court as Montana’s state Supreme Court ended a lengthy battle over the future of medical marijuana industry in Big Sky country by voting to uphold nearly all of the provisions of a restrictive 2011 law which significantly rolled back the rights of patients under its 2004 ballot initiative, approved by 62% of voters.

Despite this overwhelming level of support from the people, however, the state legislature passed the 2011 law, Senate Bill 423, over the governor’s veto to effectuate a de facto ban on dispensaries and other large-scale providers — and last week, the state’s highest court upheld all but one of SB423’s provisions, 6-1.
